It seems the FCC is gearing up to look at and enforce RFR violations.

LARGE FINES ANTICIPATED FOR RFR VIOLATIONS
Amazing as it may seem, many broadcasters profess not to
be aware of the requirement to have an RF study performed
on their tower. I hear comments such as "It's okay -- we
have had crews climbing this tower for years without any
problems." At issue is not whether there have been problems,
or even whether the FCC standards are reasonable, but rather
that those standards are the law and that it is the
responsibility of the licensee to comply.
I recently met with Linda Blair, Deputy Chief of the FCC's
Enforcement Bureau, who stated that enforcement of RF safety
standards was one of her three main goals. She emphasized
that the way they intend to achieve compliance is with large
fines, and that the first fine would be coming soon. If
anyone is unclear about the law, they can visit the FCC
website and check OET #65, or call Jerry Ulcek of the
Enforcement Bureau at 303-231-5205, Ext. 205.

Typically broadcasters have to jump through a number of hoops in
complying with RFR standards such as studies and engineering
statements on their applications. We don't, but with long distance
use of licensed-exempt radios, we do put out enough power per square
cm that can go over the ANSI limits. We need to insure that in
those situations that we meet the rules as to who can be in those
fields and how long they can be exposed. It is just a matter of
time that the FCC will start to look at community wireless networks
and WISP installations for compliance.
