I suspect that IF there is a legal issue here, it will be whether the subsequent modification of the terms of the contract was disclosed and whether the customer had a real opportunity to reject the contract after disclosure of the new terms.
To the best of my knowledge there is nothing that currently prohibits an internet provider from setting bandwidth caps. Of course, I'm sure that the folks in D.C. will be reviewing that situation now that the practice has received airtime in the mainstream media. If this one goes before the FCC, the WISP community would be wise to comment. There is no need for a band on bandwidth caps.
