There was a requirement to use with IP allocation. (would need more within 3 months, if not allocated, or something like that).
There is a legal basis to make IP holders return IPs that they are not using, or will not use within X months. Selling it on the secondary market is not the intent of the ARIN original rules, regardless of what recent decissions ARIN may have made..
