Is it necessary to go that step right away? Personally you might want to try the scare tactic on your own saying that if not necessary communication/arrangements are made, you will have to consult your personal lawyer.

I agree with the small amounts to pay off the balance....

if it is over the small claims court amount you can take it farther, but this might force them into bankruptcy and then you loose a bunch

you might try asking if they can pay small amounts monthly to pay it off
