What does "Any thoughts on why the conditions are not evaluated correctly in Maintenance mode?" mean? Are you saying that this scenario is not a fresh install to a clean system?
It's more common to use features as containers if you allow these to be added or removed at install and during maintenance mode because feature dialogs are a common part of maintenance mode.
