Reyes appointed as Associate Justice of Supreme Court

President Arroyo has appointed Court of Appeals (CA) Presiding 
Justice Ruben Reyes to the Supreme Court (SC), Press Secretary and 
Presidential Spokesman Ignacio Bunye announced yesterday. 


Reyes was chosen after Sandiganbayan Associate Justice Gregory Ong 
voluntarily relinquished his appointment to the 15-man High Court 
after questions were raised on his citizenship. 

Before becoming CA presiding justice, Reyes served as CA associate 
justice from March, 1994 to December 22, 2005. 

Reyes also served as a regional trial court judge in Bataan and 
Manila for 10 years, and was an assistant city fiscal of Manila for 
nine years. 

Reyes had been included in the short-lists prepared by the Judicial 
and Bar Council (JBC) for nominees to the 15-member SC five times 
before finally getting appointed to the High Tribunal. 

The JBC is the constitutional body which nominates candidates for 
members of the Judiciary. 

Executive Secretary Eduardo Ermita downplayed questions on Reyes' 
age, citing his acceptability to the other members of the SC and the 
support of the JBC in recommending him for appointment to the SC 
despite another possible technicality that could hinder the 
appointment. 

If the promulgation of his appointment to the SC would be deemed as 
the time of his appointment as SC associate justice, Reyes, 68, would 
only be able to serve for one year and five months before reaching 
the mandatory retirement age of 70 on January 3, 2009. 

The Constitution states that the JBC should not consider for 
nomination those who may no longer be able to serve the SC for at 
least one and one-half years, "to discourage the appointment of those 
who would not be able to serve it for a reasonably sufficient time." 

Ermita said candidates to the SC who have already hurdled the JBC's 
nomination process are already deemed qualified for appointment to 
the High Court since it is assumed that the JBC, which has the Chief 
Justice as ex-officio chairman, has already screened candidates for 
legal impediments to their possible appointment.
