I found the right fix!

From http://us3.php.net/header the correct line to insert is

$phpVm->header("Status: 302");

I've tested it using the original wp-gallery2.php file and it works!

Thanks to Andy for pointing me in the right direction. I have spend several
hours cumulatively Googling for a fix, using all combinations of 200 302
PHP-CGI etc, to no end. As soon as you pointed me in the right direction, I
found the correct thread in php.net and found the answer.

We'll send this over to the Gallery2 folks.

Cheers and thanks for the great dialog!
Kirk

Nope. I can't get it to work.

Can you insert something to check that we're modifying the right function?

die('Yup!'); would do it.
