That set_404 function could possibly also why the rewrite rules arent behaving as well? I've tried everything so far and haven't found the right set.

Of course this isn't my area of knowledge either so that doesn't help ;/

Judging by the changeset, http://core.trac.wordpress.org/ticket/14401, it
appears to have been a mistake left in debugging. I will ask dd32 about it.
