Thanks, that's what I thought. I really did not want to use it, and I found somehow strange that the guys at euroaccessibility.org have used it that way.

You need to read the spec. Validators do not alert you if you have left <form> out, that's why it seems like you can use form controls anywhere... but the real question becomes why would you want to when there are so many other tags you can use.
