The behaviour changed after the release of Firefox 1.0 / Gecko1.7x. There is this related bug in Bugzilla: <https://bugzilla.mozilla.org/show_bug.cgi?id=269908> Based on the comments, I don't expect anything to change soon.
And, agreed, it doesn't make it easier to style the legend. :-/
