You may well be right! Though in their case perhaps it's a nomenclature problem. There's a case to be made for the entities that, for example, headings and paragraphs represent. There's linearity and hierarchy to the content they describe regardless of the presentation (assuming we're representing natural language in our mark-up and not just a collection of entities).

Perhaps the heading levels could be replaced by outline levels (o1..o6, say)?

I have a horrible sinking feeling that I've just made a case for <header> and <footer> (though maybe renamed as <displaythisfirst> and <displaythislast>)!
