I can't comment on the legal question (you should ask your lawyer).

We mainly view Windows/cygwin as a development platform, so we
haven't investigated this issue ourselves.
If linking with cygwin does cause a problem, then the path forward
would probably be to work towards a port of the X10RT and X10 native
library to Win32 APIs. We've looked at a Win32 port in the past and
getting a basic implementation is probably a few months of work (or less)
by someone who is comfortable with core Win32.
If you wanted to ship a Managed X10 (Java backend of X10) product,
then the work to be done is simpler. Should mainly a port of the X10RT
native layer to Java sockets/network APIs to avoid the need for the native
x10rt library.
