It now works correctly in 2.3. Test case namespace117 covers this situation, or actually the case where you try to assign a value to the attribute: <xsl:attribute name="bee:see" namespace="bee.com">true</xsl:attribute> results in xmlns:bee="bee.com" bee:see="true" in the start tag of the appropriate element. If xsl:attribute has no content, as you illustrated, then Xalan is not obligated to emit an attribute. But the ns0:dummy="" is an illegal syntax, and we no longer generate it.
