Brian,

 You're right about that example. The current algorithm will fail. I thought
about the xsl:element case but not the xsl:attribute one. However, if we collect
the list of all instructions that can produce a new NS decl in the output, we
should be able to turn off the optimization for those cases. Can you think about
any other cases?
