For that to happen, you would need someone actively working on it.
My understanding that this would be a major undertaking.
So you'd need to find someone who has time & interest to take such an 
undertaking. Perhaps someone with an itch to scratch...

Does fairly strong business mean that you would actually be able to support 
such an effort (financially, by having someone work on it or so)?

I would also be interested in hearing what "IP" concerns you are thinking.
I wasn't aware of significant differences between Xalan and Saxon in this 
regard. In fact, given that you can get a commercial license for Saxon, most 
companies would think Saxon might be a safer option in this regard.
