Xen 3.1 dom0/domU support went into b85.
The fix you are referencing fixed one of the problems
with HVM PV drivers running on 3.1, but did not remove
the check etc. That was done in b85.
BTW, there are some more fixes around the PV driver package
which should be going back to b86..
