Declaring them yourself is permitted, but subsequent declarations are ignored. The spec requires that any declarations that you could provide must have the same replacement text as the predeclared ones. Your example matches what is in the spec, and does not in fact "escape" the value. <!ENTITY amp "&#38;"> has replacement text of '&' and not '&#38;' as you suggest (character references are "Included" within Entity Values).
