a. Is this a part of the XML specification?, or
b. Is it just an implementation assumption?
>From your description I'm getting feeling that this is purely implementation 
assumption. Am I right? 
If this is the part of the XML specification it will be desirable to have more 
clear error message in this case. However I can't find this information in the 
XML specification.
