While the reasoning behind your suggested patch sounds plausible, until we can find a *stand alone* case that exhibits this problem, it simply wouldn't be prudent for us to commit it. As you'll see from looking at the history of bug 13282, xerces seems to be quite happy about parsing the problematic files when they're presented to it in their raw form; thus, it's reasonable to assume that there's some factor in the way the parser's being used that's either causing or exposing the problem.
