This is true -- document does not have to be valid. However, "valid" [1]
and "well-formed" [2] are two different concepts.

The Infoset specification [3] clearly states the following:
"An XML document has an information set if it is well-formed".

Therefore, the DOM specification is correct in requiring the document to
be well-formed.
