The behaviour I described is a bug (Bug #18784) that I opened quite a while 
ago, however fixing it may do more harm than good for users even though they 
should be specifying URIs where they are expected and not system dependent file 
paths.

There is a feature called standard-uri-conformant [1] which when set to true 
will cause the parser to reject strings which are expected to be URIs that do 
not adhere to RFC 2396. To be backwards compatible with applications which 
treat Windows file names as if they were URIs, this feature is false by default.
