constraint 3.x.3: Attribute 'use' cannot appear in element 'attri bute'

Title: constraint 3.x.3: Attribute 'use' cannot appear in element 'attribute'

I get the following error when I try to use a schema with attribute element of the schema to have use attribute.
I am using xerces 1.4.3 latest build. The schema file is attached.
