It's very likely that if your problem has to do with default XML 
namespaces, it's from a bug in Xerces 2. Tom fixed this bug in the
CVS tree version (AFAIK, since we've benefitted), and I've informed
the Xerces 2 project team manager who has forwarded it on to the
development team (who are Sun employees in India).  I believe it's
already been fixed in their code base, but likely hasn't surfaced
publicly as a release version due to the Xerces delivery schedule. 

Suffice it to say, you'll either have to perform a workaround in
your code or be sure to use the latest Xindice code, or both.
