Cadres,

I understand arguments advanced by comrades, however what is important is that
the leadership of the ANC has finally clarified the facts on the so-called Vavi
matter. The decision needs to be accepted and respected in that context.

Matters of principle such as whether the ANC can charge any member or leader of
another alliance partner for expressing a position of an independent structure
is constitutional or not, need to be deliberated at the branch level and tabled
for consideration in the National General Council in September 2010.

In this way, we would be able to iron out the ambiguity with regard to
issues of this nature in the future. Corruption is corruption, it can never be
contextualised. Therefore those implicated in corruption should learn to clear
their names within the structures or make representations on why they are being
implicated before the matter is blown out of proportion by the media and
opposition parties.

In that way, the reputation of the organisation does not get hurt or
compromised. We cannot preach zero tolerance on corruption and then keep silent
when our own deployees are implicated in some form of tender irregularities. It
does not make sense - otherwise it will create impression that there
is different corruption for different people.

In fact, it should not matter whether COSATU or SACP raises the matter, what is
pressing remains the prima facie allegation of corruption implicating our own
comrades. I submit therefore that let the matter be resolved by the NGC.

Comradely

indeed the contradictions need to become more sharper and our role as
revolutionaries is to make them sharpest  so that real change do happen.

Comrades,

The most positive thing to come out of this is the extent to which
contradictions are sharpening within the broader movement. Those that "did not
struggle to be poor" did not all leave to form Cope some are still within our
ranks. For these comrades accummulating wealth and crass materialism for the
elite is the main aim of the NDR. This development exposes what the
realunderlying challenges that preclude our movement from providing leadership
to society on many fronts.

I also think this is a positive development because the attempt to silence
COSATU means they are panicking and COSATU's and SACP's rogorous campaign
against corruption is having an effect on them. All of us within our alliance
formations including the ANC must continue to speak out against corruption,
conspicuous consumption and a total disregard of the interests of the working
class and the poor. COSATU & SACP in KZN are doing well in this regard.

The NWC of our Movement has taken a correct decision by not going ahead with
the intended disciplinary action as it was very ill advised in the first place.
Forget the "long rope" that is supposedly being given to the COSATU GS to "hang
himself", the comrades in the NWC know exactly they cannot proceed in this
manner.

I therefore think the "swell the ranks" call is even more relevant. Can you
imagine if the working class and the poor were to leave the alliance - these
same corrupt elements would have a field day. These are the same elements whose
revolutionary conscience does not tell them it is a contravention of the Public
Finance Management Act to splash millions of rands on World Cup tickets for fat
cats who are earning millions in state departments and parastatals.

Comradely Regards,

Thembela.

Dear Comrades,

My own view is that it was totally wrong for the ANC to even think about
charging Vavi under these circumstances.  It is standard practice for COSATU,
indeed for the whole congress movement, that after every meeting of
constitutional structures,  a press conference is held and a statement issued
to communicate what was discussed and resolved.  An impression is being created
that comrade Vavi simply spoke out of the blue!  The Central Executive
Committee (CEC) of COSATU met from 24 - 26 May 2010 and the next day a press
conference was addressed by the COSATU National Office Bearers where comrade
Vavi read the CEC statement and answered questions from journalists.

The EKURHULENI DECLARATION OF THE ALLIANCE dated 7 April 2002 states as follows
on Managing Intra-Alliance Relations;

“Our organisations, though profoundly inter-dependent, are separate
organisational formations with their own identities, policy-making mechanisms
and internal organisational arrangements. In this regard, each component
respects the independence of its allies.
The summit discussed a range of challenges emerging out of managing
intra-alliance relations. In general it was agreed that none of these
challenges, including the question of multiple mandates and overlapping
membership, pose insuperable problems to the effective management and
consolidation of the Alliance. It is a source of strength for the Alliance that
many members of one partner are also members of other components.
Having examined the causes and the impact of recent intense public discord
among some components of the Alliance, the Summit concluded that this was an
unfortunate development which we should not allow to recur. We do acknowledge
that it would be artificial to expect that tensions would not exist among and
even within components of the Alliance. The challenge is how we manage them
within our constitutional structures, and use them as a catalyst for the growth
and maturity of our organisations.”

The ALLIANCE DECLARATION ‘EKURHULENI II’ of April 2005 re-affirmed this and
went further to say, “…we agreed to conduct our debates and air real
differences, where they may occur, in ways that build unity, and enable the
Alliance to provide leadership to our society in general.”

I would argue that the COSATU statement and Vavi’s response to the journalist
when he was clarifying what COSATU meant is not at all in violation of the
Alliance protocol.  On the other hand, threats to discipline Vavi seek to
undermine the independence of COSATU.  That is why COSATU’s affiliates sprang
to Vavi’s defence.  As General Secretary, comrade Vavi is the chief
spokesperson of COSATU, which is why the statement was read by him!  For
comrade Nyanda to resort to court action seems to be over the top.  Why did he
not sue the newspapers at the time they published the negative articles about
him?  He is in fact the one who is bringing the movement into disrepute!

Down with tenderpreneurship Down!!!

ANC Statement, 22 June 2010

National Working Committee Statement

The National Working Committee held its normal bi-weekly meeting on Monday 21
June 2010, at Luthuli House. The focus of the meeting was on the preparations
for the National General Council in September 2010. The first draft discussion
policy papers were tabled for consideration by the NWC. The NWC agreed that the
process of consolidating these papers should continue and the next two Mondays
be used by the NWC for refining all these policy papers in time for the next
National Executive Committee meeting where all these NGC discussion documents
will be signed off.

The meeting also received the report from the officials on the so-called Vavi
matter. It is important that we first clarify the facts on this matter as it
has been kept on the public domain for the past three weeks on the basis of a
leak to journalists regarding discussions in the NWC meeting of 30 May 2010. In
this meeting an issue was raised about the public pronouncements by members of
the ANC who happen to be leaders in other alliance components.

These pronouncements which amounted to public spats also dragged names of other
leaders through the mud. An observation was then made that on the part of the
general secretary of COSATU, cde Zwelinzima Vavi, this has become a norm,
wherein innuendo was used to caricature some unnamed leaders of the ANC as
corrupt. In trying to qualify his pronouncements on corruption in the ANC, the
names of cde Siphiwe Nyanda and Sicelo Shiceka were specifically mentioned
whether voluntarily by comrade Vavi or in answering questions from journalists.

It was the view of the NWC that pronouncements by Cde Vavi have gone too far.
The possibility of charging comrade Vavi was put as a possible option with the
proviso that facts about this incident be investigated.

Having been seized with this matter for some time now the NWC has now decided
that the following principles be clarified: -

In terms of the ANC Constitution “all members, without exception, must abide by
the Constitution of the ANC, and the Rules and Regulations, the Standing Orders
and Codes of Conduct, as adopted or amended from time to time, as well as all
policies and decisions properly adopted or made in terms of the Constitution”.
This observation clarifies the question of whether the ANC can charge comrade
Vavi or not. There is no question of any member being exempted from being
charged on the basis of such a member being a leader of another alliance
partner. It is not COSATU that is a member of the ANC but thousands of
individual members who have joined the ANC individually also in some instances
joined unions in their respective workplaces. There is no COSATU block
membership in the ANC.
The history of our movement is full of names of comrades who were charged
whilst being leaders of the alliance component and determination made about
their behaviour and conduct within the ANC. It is therefore being economical
with facts and truth to say it has never happened in the history of the
alliance to charge leaders of other alliance partners, including after the
unbanning.
There is therefore no question of the ANC being unable to charge its members
because they happen to be leaders of one or the other alliance partner. These
individual members are expected to defend the congress movement irrespective of
the company they find themselves in.
Having made these observations the NWC decided that: -

In dealing with this alien behaviour charging comrade Vavi will not be the best
route to take.
This is a political problem that must be addressed as such.
In dealing with this matter politically, COSATU will be engaged directly and
asked to abide by the decisions taken by the alliance structures. COSATU will
be asked to particularly observe our decisions on stopping public spats and
also the ease with which fellow comrades or leaders are attacked in public.
The generalisation in talking about corruption must end and all the leaders of
the movement must be specific in raising issues particularly around corruption.
Mentioning names of individual comrades as corrupt without facts is dangerous
in that when such comrades are cleared the allegation will not disappear. The
example would be the isolation of comrade Siphiwe Nyanda as corrupt for staying
in a hotel while waiting for official residence to be allocated by Public Works
which applies to all ministers and deputy ministers. We believe that such
accusations of corruption levelled against cde Nyanda and others in similar
circumstances, is stretching things too far, smacks of mischief and is totally
disingenuous.
When any alliance partner has issues that are serious enough to receive our
attention, such a partner has a duty and responsibility to engage with us
before going public and be seen to be attacking another partner.
In future this behaviour by individual members of the ANC will be closely
monitored and there will be consequences whenever any deviant behaviour is
observed.
The NWC also took the opportunity to wish Bafana Bafana well in their 2010 FIFA
World Cup encounter with France today.

The ANC remains confident that Bafana Bafana can still make the country proud.
We are also pleased by the support that Bafana Bafana continues to receive from
all South Africans.

South Africans have shown the entire world that they are good hosts, we are
also confident that South Africa will continue to show this passion until the
end of the FIFA World Cup. We are already winners as South Africa for hosting
the most successful FIFA World Cup. LET’S HOLD OUR HEADS HIGH!!!
