Labour Courthas dismissed a case by SAPS and DCS to interdict our members
 
We has noted that at around 23H30 on 25th August 2010 the employer; herein 
referred to as SAPS and DCS have secured an interim court order to interdict 
all 
our members from participating in the current national public service march as 
are taking place across the country led by COSATU.. And our Legal Team appealed 
the interim order.
 
We argued that we agree that some of our members as employed under the 
Correctional Service Act and Police Act are not allowed to strike and that our 
Non-Essential members as employed under the Public Service Act are allowed to 
strike as per the 2007 Court Order.
 
The employer argued that their case is based on the statement as released by 
POPCRU on the 25th August 2010 and as per some media reports and the Labour 
Court argued that there is insufficient information to declare an order in the 
favour of Department of Correctional Services..
 
The case was dismissed by the Labour Court.
