MEDIA STATEMENT 03rd September 2010 POPCRU welcomes the outcome of the Labour Appeal Court: Declaring of Public Service Act employees in SAPS as non-essential
The question to be resolved in this appeal was whether the designation of the South African Police Service as an “essential services” in terms of the Labour Relations Act prohibits all of the personnel of the South African Police Services from participating in a strike or whether the prohibition applies only to those members of staff who are deemed to be members of the SAPS as defined under the South African Police Services Act. Today on the 3rd of September 2010, the Labour Appeal Court has dismissed the appeal by SAPS on the judgment that the prohibition does not apply to employees of SAPS who are not employed under the South African Police Act. It is now official that employees in this category have a right to strike as they are not designated as essential services and therefore can go on strike after following all the legal process as outlined in the Labour Relations Act. This is a victory for the organization given that SAPS has been obstinate that such employees can therefore not go on strike as their employer is designated as essential service. This further came at a crucial time where the public service unions are on strike, in an effort to persuade the state as the employer to meet its demands. This outcome strengthens the position of the organization in further dealing with all matters where such a prohibition was used to undermine collective bargaining process by the SAPS as the employer.
