SACP NORTH WEST REJECT INTENTIONS OF THE NPA Wednesday, 15 September 2010 The South African Communist Party (SACP) in the North West province regards very problematic the intentions by the National Prosecuting Authority (NPA) to appeal against bail for the Eugene Terreblanche murder suspects. It is our view and believes that this action will in many ways show how other institutions are undermining our democracy and the constitution of the country. Firstly there are many black farm workers who have been killed by white farmers and at no stage has the NPA ever challenged the granting of bail by the courts in this province. The so-called Terreblanche killing accused are entitled to their constitutional right to get bail precisely because of their rights to be presumed innocent until proven guilty by a court of law, this legal principle cannot be compromised on the basis of siding with supremacist white racists against poor black workers.
In many instances the NPA always defended itself from people who opposed bail for many criminals in the country – by saying the accused are entitled to bail based on their constitutional right, but in this case the constitutional right to get bail does not apply – this is a very dangerous prosecutorial behavior and conduct . As the SACP in the North West province we will challenge by all means necessary any intention to erode the democratic victory of our people, especially the workers and poor, not forgetting that there have been cases in which Black farm workers were killed for being mistaken to be dogs and baboons by white farmers – in these cases the NPA never appealed against their bail – therefore we do not accept any reason for appealing against workers who are charged with murder of a supremacist racist murderer like Terreblanche. Together with our most revolutionary and reliable alliance partner COSATU we shall defend the workers and the poor of our province and will never if this intention by the NPA is not reversed fail to support those workers , who have been turned into victims of racism, manifesting itself through the NPA and its racist allies in the North West province in their attempt to appeal against a legal right of the accused to get bail.
