This is really a true reflection of how our people are still ill treated in 
areas where justice is non-existent!!

Its absolutely disgusting that in this day in age we still have such cases. My 
concern is that cases where farm workers or workers in factories are victims, 
perpetrators get off because of their ability to afford defense lawyers with    
expertise and experience. . . The system remains exclusive to a certain class, 
to the detriment of the majority

COSATU appalled at sexual assault of workers

 

The Congress of South African Trade Unions is disgusted and outraged at the
assault and degradation of four young black workers by their employers at
the AC Wendy carpentry factory in Blackheath, Cape Town. 

The attack happened at midnight on Tuesday 5th April 2011, after four
workers, aged between 20 and 26, went to the factory to look for casual
work. They were offered a day's employment and worked without a break from
7am to 11pm. 

When they asked to be paid, the bosses' response was first to beat them up
and then held them at gunpoint and forced them to suck their private parts.
They were then forced to drink water mixed with urine from toilet bowls.
Under the new Sexual Offences Act, forcing someone to perform oral sex is
considered to be rape. 

Afterwards, in what clearly reveals a political and racist motive for the
assault, the bosses named the four "Zuma", "Blade", "Vavi" and "Malema" and
demanded to know why black people had murdered AWB leader Eugene
Terre'Blanche. 

The workers managed to escape and reported the incident at the Mfuleni
police station, only to be told that because the perpetrators had guns, they
would go to the factory another time. They then took the victims home
without opening a case.

COSATU congratulates the members of the Brian Bunting SACP Branch who led
300 community members on a march to the police station to demand the arrest
of the alleged perpetrators. We are pleased that the SAPS have now arrested
the factory owners and charged them with assault, indecent assault, crimen
injuria and intimidation. They are to appear in the Blue Downs magistrate's
court tomorrow, 14 April.

COSATU supports the SACP's demand for a full investigation into the case and
disciplinary action against those police officers who did not attend to the
case when it was first reported. 

This horrifying story illustrates in the most grotesque and extreme manner
how too many employers treat their workers. Those who argue for the
relaxation of our 'inflexible' labour laws should take note of this case. It
provides further proof that workers get not too much but too little
protection from our laws, which are blatantly flouted by employers like
these.

 

Should the accused be found guilty, COSATU demand that harshest possible
sentence be imposed on the accused, so as to send out a clear message that
abuse, assault, racism, degradation and super-exploitation of workers will
not be tolerated.
