*YCL support Malema’s constitutional Rights *

The Young Communist League of South Africa [uFasimba] notes with serious
concern the on-going novelty in the media as it relates to allegations of
corruption against the President of the ANCYL comrade Julius Malema. At
first YCL did not want to issue any statement on the matter, we hoped that
law enforcement agencies will speedily bring closure in the matter.

We have however noted with keen interest that every week new and fresh
allegations are levelled against the ANCYL President and that these
allegations amount to billions of Rand and involve money laundering,
corruption and in the main threaten the unity not only of the ANC but, the
entire alliance. It is this realisation, especially because we do not know
what will come out next week and the week that will follow which made us to
break our silence on the matter.

*We are opposed to media trial*

As a matter of principle the Young Communist League of South Africa, opposes
the trial which is initiated, conducted and concluded in the media. The
ANC-led alliance has a long history of leaders who were trialled by the
media and the court of public opinion only to be found innocent by the court
of law. As an organisation given this historical understanding and the
manner in which the president of the ANCYL had been projected we would like
to call upon the people of South Africa to uphold the principle of
presumption of innocent till proven guilty by the court of law, particularly
because the President of the ANCYL has not been called before the court.

* The Dark cloud over Malema’s head*

While the above is true, it is also our conviction as the organisation that
as President Malema’s media trial is underway (in the media), the image had
been painted that he is a corrupt spoiled brat, who uses Nationalisation
call to destabilise President Zuma’s administration while benefiting from
Privatisation in Limpopo. If this is not cleared the name Malema will be
portrayed as synonymous with corruption, money laundering and as a symbol of
anarchy. Amongst other things we have learnt through media that:

·         “Julius Malema is rolling out state tenders to his pals through a
company that is part-owned by his family trust. The Ratanang Family Trust,
founded by Malema, the ANC Youth League leader, holds shares in On-Point
Engineering, which administers a large part of the multibillion-rand budget
of Limpopo's roads and transport department. This means that Malema has at
least indirect influence over who is awarded tenders from a three-year
budget allocation of reportedly R4.6-billion.”

·         In 2009, the department set up a programme management unit (PMU)
to take over many of the department's functions in planning, contracting for
and overseeing road works. In a twist at odds with Malema's stance on
nationalisation, it outsourced the running of the unit to On-Point for three
years at a fee of R52-million.

·         “There are tenders in this province that were not advertised.
These tenders were given to boys who are leaders and members of the youth
league, including Malema’s cousin,"

·         “City Press reported that a Limpopo businessman had confirmed
depositing R200000 into the Ratanang Family Trust, which was suspected to be
funding Mr Malema’s lavish lifestyle.

·         It is also alleged that businessman Matome Hlamboa, who obtained
government tenders in Limpopo to the value of approximately R200 million,
provides Malema with a vehicle to the value of R1, 2 million and also did
him a number of other favours.

·         Steve Bosch had made two payments on behalf of Malema to the value
of R1, 2 million to Aurielo Cimato, the architect building Malema's
multimillion home in Sandton.

        *The President is also projected as Mr. Cash *

·         “Malema has gone on holiday with a few friends and gave out R78
000 in a five star resort close to the Kruger National Park.”

·         “rented the house at R18 000 a month and paid the rent for a full
year up front”

·         Paid a cash deposit of R360 000 on one property;

·         Settled the outstanding amount of more than R1.7m on the R3.6m
bond after an Absa bond of R1.5m paid out in “two or three” cash deposits
into his account shortly after the sale went through.

·         Paid R50 000 rand fine in cash, after having apologized for his
derogatory remark toward a woman.

·         R800 000 deposit on the 139 hectare farm in Limpopo, which he
later withdraw

The above illustrate, but just some of the allegation levelled against the
President of the Youth League, there are many other issues that had been
raised which are cantered on his lifestyle, and allegations are that he
leads an opulent life. This in our view represents dark cloud hanging over
the head of the Youth League president.

*Investigate allegations to clear Malema*

All these corruption allegations pose a threat to the unity of the alliance,
and since a group of powerful business men are implicated in having funded
these projects which are said to be a recipe of regime change in 2012.  We
are emphatically convinced that these allegations should be investigated.
Those who are corrupt know very well that the public hate corruption, thus
they will present those they strive to remove from position of power as
corrupt so to position their friends, to extend their hold on state tenders.
As YCLSA we believe that this is a biggest threat to our revolution.

Capitalist and their running agents will co-opt some amongst the “raising
stars” as their mouthpiece within the liberation movement, who will speak
popular language to hoodwink the masses of our people for the benefit of the
few. These individuals will break away from the resolved organisational
practice, culture and traditions. They will report to those who bank-roll
their lavish life style. Their influence in the business world will be
linked to their political power, once gone they will become a spent force in
the capitalist world, thus they will do everything possible to cling into
power.  As the dependable ally of the ANCLY, YCL will not like such to be
associated with the YL.

It is because of this political understanding that as the Young Communist
League, we are today propelled to call for an investigation to all
allegations against the President of the ANCYL, so as to take away the dark
cloud already hanging over his head. If any of the senior leadership of the
alliance had deposited millions in his family trust fund, such must be
investigated as well. This will have long effect on the unity of the
alliance and will bring peace to the life of the ANCYL president who has
been a subject of media trial for far too long and his Rights may had been
violated, but of cause if guilty he must face the music.

As the Young Communist League we stand by what befits the revolutionary
morality that coins the calibre of all those in the positions of power
within our movement and the state. We take stock of our conviction that our
leaders should never be corruptible, for their status of ‘leader’ should
neither be bought or seized but earned through self sacrifice in a
revolutionary cause which offers no immediate personal reward, and little
prospect even of possible reward in the future. Any contradiction that
exists between incorruptibility and self-sacrifice when out of power and
widespread corruption and self enrichment when in power is an unpardonable
misconduct that should be aggressively reprimanded by both, our movement and
law enforcement agencies.
