Media Statement 22nd November 2011 Settlement of Election Remuneration Dispute POPCRU has secured another victory for Workers employed within the South African Police Services in relation to payment of remuneration over Election. This matter was heard at the Safety and Security Sectoral Bargaining council, Case No; PSSS 87-11/22 on a matter ‘whether the members of the applicants [POPCRU] are entitled to the payment of the allowance in terms of SSSBC Agreement No.1/2010 or the payment of overtime in terms of SSSBC Agreement No.4/2007 over the election period of 17 to 19th May 2011. We argued that members who worked on the same dates are entitled to allowances and also overtime for the 18th May as it was declared a public holiday by the president of the country. It was further argued that the interpretation of Clause 5 of SSSBC Agreement No.1/2010 would result in injustice, unfairness and amount to an absurdity. Issue of writing agreements in clear and precise terms to avoid ambiguity as the interpretation was a bone of contention. It was further argued that ‘no one had considered what would happen if a public holiday and a special event fell on the same day’. And if the respondent's argument would be accepted; it would have the implication that the respondent can negate the provisions of SSSBC Agreement No.4/2007 in respect of payment of public holidays by simply declaring every public holiday a special event. An Award was secured which ordered the respondent [SAPS] for the payment of allowances for members, who worked on the 17th May to the 19th may 2011 and over-time payment to be effected for members who worked on the 18th May 2011.
