Cde’s I don’t think anyone expects the ANC to “laugh along and be merry on such 
acts.” However as a movement that is 100 years old, today, I think it would 
have been more appropriate for the organisation to handle the issue with a bit 
more consideration, understanding the nature of perceptions that have come 
along with it.

 

Critiscm and reciprocal critiscm between individuals of an organisation are 
good if the salient point is to ensure progress. The point I’m trying to make 
is that; holding divergent views with the leadership should not be considered 
to be improper as long as the views are not in conflict with the general aims 
objectives of the movement.

 

Perhaps the need to look deeper into the statements made by Malema and their 
accuracy, or lack thereof, becomes more important. How do you suspend an 
already suspended/expelled person? This action by the NDCA could be further 
viewed as validating Malema’s statements that “those that hold opposing views 
are silenced / oppressed whilst those that are in support of the current crop 
of leaders are encouraged to openly campaign.”

 

I don’t want to be perceived to be in support of Malema’s recent public spats, 
however an analysis into the actions of the NDCA do leave a lot to question, 
considering they (NDCA) were due to make a statement on the entire issue in a 
weeks time. With less than a week before the NDCA announces its judgement, on 
the Malema issue, one has to ask the following questions:

 

1.      Was it really necessary for such an action so late on in the 
dispute?2.      How many more public gatherings would Malema have addressed 
from yesterday right up to next week Thursday?3.      How much more harm could 
Malema have done to the ANC, or its leaders, in the space of a week?4.      How 
does this announcement then present itself in the face of the expected outcomes 
from the Disciplinary Hearing next week? 

The lecture at Wits was supposed to be about celebrating 100 years of the 
liberation movement celebrating the trials and tribulations of the movement and 
how far it has come, I fully agree. What we must also be mindful of is that 
statements and actions that have been conveyed by Malema can also be construed 
to be part of this history. These, are all part of the present day challenges 
that the movement is facing at this current juncture in time; not forgetting 
that through the different generations and times that the ANC has lived through 
it has faced different struggles and different character. Malema’s recent 
public antics could, perhaps, be viewed as part of the struggles of this 
current epoch.

 

The centenary lectures should also be about aligning the past to the present, 
and as such it is equally important, then, to raise issues that affect the 
movement today. The manner in which they have been raised might not be 
desirable, however as a movement that is encouraging of divergent views it was 
rather flawed to act on the dissident views expressed by Malema and his 
accomplices.

 

“The lecture at Wits was a platform created to educate young people, some who 
are not even part of the YL and the YCL to understand the history of the 
movement to a point that it generates interest from them to join and be part of 
the movement and make a difference” Yes I fully agree to this statement; I do 
however have a difficulty in understanding where this youth would be coming 
from. I am deliberately saying this because: Whilst majority of young people in 
this country may not be aligned to the YL, YCL or any political formation, they 
do follow or are on par with the current happenings in the political landscape 
of this country.

 

Part of the youth’s generating of interest to join the ANC, YL or the YCL, for 
that matter, should happen within them grasping and accepting the status of the 
ANC, currently, and not on the history lesson that they would be given of it, 
and its contribution to the liberation struggle of South Africa.

 

The current schisms that have engulfed our movement require us to develop new 
strategies and tactics to overcoming them, strategies that will be based on a 
concrete analysis of concrete reality. This view that Malema’s statements are 
going to scare people off, or, discourage them from joining the ANC is not only 
fallacious, but also unproven. If anything; Malema’s statements are finding 
resonance amongst the poor, even though they (the poor) are likely to benefit 
the least from them, nor are they the intended recipients of such statements. 

In order to ensure triumph in such situations; members of the ANC, together 
with their branches, need to debate these issues with open minds, rather than 
along factional lines. The ANC can, and will, only grow when we can learn to be 
pragmatic in our discussions and stop romanticism.

COMRADE JULIUS MALEMAS IMMEDIATE SUSPENSION

_Pending Disciplinary Proceedings_

 At a meeting on 2 April 2012, the NDC decided to suspend comrade Julius
Malemas membership of the ANC with immediate effect in accordance with the
provisions of Rule 25.12 (c) of the ANC Constitution. 

The NDC considered the nature and seriousness of comrade Malemas utterance,
namely

   ....It is under President Zuma that we have seen the youth of the ANC
being traumatised, being expelled from their own home. It is under President
Zuma we have seen a critical voice being suppressed We have seen under
President Zuma, democracy being replaced with dictatorship. We have seen an
intolerance....people, who become impatient with the youth....,

at a meeting held on 30 March 2012 at the University of Witwatersrand,
Johannesburg, and concluded that such utterance could bring the ANC into
disrepute as contemplated in Rule 25.5 of the ANC Constitution. 

After due consideration, the NDC was satisfied that this utterance
constitutes a very serious violation of the ANC Constitution and that the
institution of disciplinary action, as provided for in Rule 25.3, and
temporary suspension of comrade Malema, in terms of Rule 25.12(c), of the ANC
Constitution is warranted. 

The NDC also took cognizance of the fact that the said utterance received
widespread coverage in the print and electronic media. 

Comrade Malema was informed this morning of his immediate temporary
suspension and that disciplinary proceedings would be instituted against him
by the NDC, and that he would be provided with full details of the charge/s
and details of the disciplinary hearings in due course.

In keeping with the principle and spirit of natural justice and to remove any
semblance and perception of bias, the members of the NDC who participated in
this decision to institute disciplinary action against comrade Malema will
recuse themselves and not participate or adjudicate in the pending
disciplinary action against him. 

The NDC has stipulated the following conditions that comrade Malema will be
required to comply with during his suspension:- 

 * He will not exercise any duty in his capacity as an ANC member, President
of the ANC Youth League and/or Member of the Provincial Executive Committee
of the ANC Limpopo Province;

 * He will not attend any meeting of the ANC or any of its structures,
including the Leagues, except for the purpose of the NDCA hearing and the
pending disciplinary proceedings to be instituted against him.

 * He will not address any meeting of the ANC or any of its structures,
including the Leagues, whether as an invited guest, in his capacity as
President of the ANC Youth League and/or as a member of the ANC; and

 * He will not make any public statement on any matter pertaining to the ANC.


The temporary and immediate suspension of comrade Malema will come into
effect on Wednesday, 4 April 2012.
