What is in the Post?
For some time now, we have heard gossips, accusations, allegations, insults and 
observed loggerheads amongst both the political leadership of the Modimolle 
Local Municipality, who grew intolerance to each other without bearing the 
facts of their appointments at hearts. These animosities were given grace by 
either lack of knowledge and information or too much comprehension of statutes.

Whether the point might be, i find the basis for such episodes unwarranted and 
below the intelligence. The political or factional intolerance remains the key 
benefactor and a leading force to destabilize the overall functioning of the 
municipality and further subject residents to inhumane circumstances, however, 
reasoning to this challenge must be provided or if not, should be located.

In the event of such provisions, the law should be in the nucleus of it all, 
understanding of it thereto, shall be a matter of opinion, but we are yet to 
understand whose responsibility it is to interpret factually what the law says, 
except those that must work with it on daily basis, either as managers, 
clerical staff or even political leadership. But at the end the law should be 
understood, respected and upheld.

In terms of the Amended Municipal Systems Act, putting emphasis on Section 
54A.1, (2) “A person appointed as municipal manager in terms of subsection (1) 
must at least have the skills, expertise, competencies and qualifications as 
prescribed.”  Which in a logical sequence make provision for no nervous tension 
to appoint for as long as the post is advertised, shortlisted and interviews 
are conducted.

Without understanding the ramification of having a person acting for a period 
above the legal prescriptions, the leadership seems not bothered, thus the 
provision of the same Act,(2A) (a)” A person appointed in terms of subsection 
(1)(b) may not be appointed to act for a period that exceeds three months.” 
Which the case in Modimolle is exceedingly opposed to the law.

As a concerned resident of the Modimolle Local Municipality, i am entitled to 
knowing the future of the municipality and perhaps zoom a bit in on factors 
that might be derailing appointments and where does service delivery feature or 
who is a beneficiary of such a stall. After careful investigation and 
combination of facts, i felt it proper to declare Modimolle an Island.

Letters, memos and legal pledge are since October been the discussion amongst 
ANC Councillors, and when the Council meeting is supposed to be held to deal 
with issues which will take Modimolle forward, it is characterised by 
infightings and anything unholy .
The grapevine and societal rumour that is left by this monotonous activities is 
that the preference of the seniors in council are either not qualifying or are 
implicated in legally incorrect elements, which both allegations are refuted or 
are felt to deserve being swept under the rug, but this should not be the case 
for audience, rather we ask what is in the post?

Should self serving interest supersede the tranquil of meticulous operations, 
and since the upholding of legal frameworks seems confusing to those that must 
implement them, then the public opinion experts should ask few questions which 
might be easily responded to.

We are told that the vetting process has found that Roger Nkhumisha, the former 
Municipal Manager in Thabazimbi, is found to have a criminal case, apparently 
for eluding value added tax payment which he since settled the debts, therefore 
what kind of a criminal cases are off limits to appoint a person with 
experience and more than qualified?

Our ears are also fed with languages that Matuma “Lolo” Selamolela, the former 
Manager Social Services in Modimolle is without qualifications necessary for 
the post and contradictory to the advert of the Municipal Manager as placed on 
the National Newspapers as encapsulated in the act.

The Act says:” (3) If a post referred to in subsection (1)(a)(i) becomes 
vacant, the municipal council must—
(a) advertise the post nationally to attract a pool of candidates nationwide; 
and (b) select from the pool of candidates a suitable person who complies with 
the prescribed requirements for appointment to the post.”

Therefore one is tempted to ask also, that what was the criteria for short 
listing and that between vetting and interviewing which comes first, can it be 
that the system was violated or some of its aspects are thought of only when 
technicalities were needed to beef up arguments.

What is it that is so special about the two amongst many applicants, which 
backs senior politician to allow services to suffer, have an acting municipal 
manager doing so above the duration prescribed by the act, isn’t all this 
fruitless expenditure?

I am soberly making a call to residents of Modimolle to impress on the matter 
or jointly combine views and write to the Public Protector to protect us 
against what we don t know. 

What is so tough to decide whether a person qualifies or not, or if the person 
is a criminal or not.
