NUM to fight retrenchments at

 

ASA Dilokong Chrome Mine in Limpopo

 

 

The National Union Mineworkers (NUM) is shocked and saddened that ASA
Dilokong Chrome Mine in Limpopo had served the NUM with Section 189 notice
of the Labour Relations Act to retrench 700 workers.

 

ASA Dilokong Mine is contemplating retrenchment of up to 700 employees in
their operation and remains with few employees who are going to do
maintenance of the mine.

 

The NUM strongly condemns the behaviour of this arrogant company not to
follow the due processes of the law in terms of the Labour Relations Act
(LRA) and Minerals and Petroleum Resources Development Act (MPRDA). It is
evident that the company is undermining the Department of Mineral Resources
(DMR). It is regrettable and unacceptable to see DMR being undermined and
disrespected by this company.

 

The company must implement Section 189 of the Labour Relations Act of 1995
at the same time with the  Minerals and Petroleum Resources Development
(MPRDA) Act of 2002 Section 52 which states that if the company anticipate
to retrench 10% or more employees it has to inform the Minister of Minerals
Resources. The NUM request Minister of Mineral Resources Mosebenzi Zwane to
intervene immediately to stop this drastic action by the company that will
leave hundreds of mineworkers in a dire situation and the surrounding
communities in Limpopo. The high number of retrenchments will contribute to
a high unemployment rate in South Africa which is sitting at 25,5%.

 

The NUM is also highly disturbed and disappointed with the company for
refusing to meet with the NUM leadership to try and resolve the problems.
The company has turned down several requests to meet them since the 14th of
December 2015. 

 

As the NUM, we are going to make sure that this company together with
Limpopo Economic development is not going to run away with the crime. We are
also busy consulting with our legal team to challenge the non-payment of all
employees since November last year by this arrogant employer.

 

"We want to appeal to the Commission for Conciliation, Mediation and
Arbitration (CCMA) to prioritise this matter and do the correct thing by
calling the parties to a facilitation process. It is highly questionable why
the CCMA cannot put priority on this issue," said Phillip Mankge, NUM North
East Regional Secretary.

 

"The NUM extremely disappointed that the Limpopo Economic Development
department and the board of directors of this company in the manner they
handled this matter, it is evident that they are powerless and are
controlled by a mere HR Manager who is calling shots from this company,"
Mankge added.

 

As the NUM, we will fight tooth and nail to make sure that these
retrenchments do not happen. 

 

The NUM will continue to defend and protect the job security of mineworkers
at all cost. 

 

The NUM in its 34 years of existence had fought very hard against the brutal
apartheid regime and employers. We remain unshaken and will not be
intimidated by this arrogant company ASA Metals.
