NCDHR - NATIONAL CAMPAIGN ON DALIT HUMAN RITHTS

NCDHR HOLDS PUBLIC HEARING ON THE ATROCITIES UNLEASHED ON DALITS IN THE
SOUTHERN STATES OF INDIA
  (6TH & 7TH FEB – 2006 – BANGALORE)

Dalits, who constitute one fifth of the population in India, still face the
inhuman practice of Untouchability in all Socio, Economic and Political spheres
of their life. Very particularly their life and security is at stake owing to
the enormous amount of atrocity unleashed on them owing to untouchability and
caste based discrimination. Even the slightest sense of assertion of Dalits
and their resistance against various forms of human rights violations results
in gruesome murders, rape, arson, social boycott, harassment and humiliations.
Atrocities on Dalits in the 5 Southern states of India is increasingly rampant
and the so called Constitutional Provisions, Special Legislations and the
whole lot of Criminal Justice Administrative systems have miserably failed to
protect and safe guard the life, property and dignity of this hapless masses.

NCDHR, a larger Platform of Dalit Activists and Academics, formed in 1998 has
been addressing the issue of caste based discrimination both within and outside
this country with Advocacy Intervention under the Human Rights perspective. It
gives visibility to this issue of Dalits with the slogans “Dalit Rights are
Human Rights” and “Caste out Caste”. NCDHR has capacitated more than 700 Dalit
Youth - both Men and Women – in 14 States of India, to undertake the
“Monitoring of Atrocities” unleashed on Dalits. These skilled
Dalit Youth have undertaken hundreds of Fact Findings (FFs) for the last two
years in all these states on the atrocities that have been reported through
Primary and Secondary sources. NCDHR, based on the reports of these FFs done in
the 5 Southern States – ANDHRA PRADESH, TAMIL NADU, PONDICHERRY, KARNATAKA and
KERALA, has decided to hold a Public Hearing in Bangalore on the 6th and 7th
February 2006 with the following objectives:

To render Justice to the Dalit Victims.
To ensure compensation to the Victims who lost their lives and properties.
To hold the state Accountable for these Human Rights Violations on Dalits.
To Sensitize the Civil Society Organisations to take the issue of Dalits
effectively.
To expose the failure of the Criminal Justice Administrative systems of this
country in addressing this heinous crimes.
To initiate Advocacy interventions with the State, Law Enforcement Agencies
and Human Rights Mechanisms available in this country to ensure justice to the
Victims.
To file a PIL in the appropriate Courts based on the outcome of this Public
Hearing.
To bring it to the notice of the International Human Rights Mechanisms on
the ineffectiveness of the Protective and Legal measures of this country in
ensuring protection to this vulnerable and discriminated groups.
To ensure protection to the victims from intimidation and threats.
To initiate Private Complaints against the erring officials under the SC/ST
(Prevention Of Atrocities) Act 1989 for their willful negligence in rendering
justice to the affected victims.
To challenge and crack the unwritten practice of IMPUNITY that has been
enjoyed by the Non Dalits who inflict violence on Dalits in the name of Caste
and Untouchability which has got a Religious sanction in this country.

The State Chapters of NCDHR from Andhra Pradesh, Tamil Nadu, Pondicherry,
Karnataka and Kerala have identified Dalit victims who faced various forms of
violence in the hands of the Non Dalits and bring these victims who will
depose before the eminent Jury Members who represent all these states. NCDHR
has already sent invitations to all Revenue and Police officials who dealt
these cases to come and explain their standpoint and also report before the
Jury members on the actions taken by them in addressing such violence. Also a
number of Dalit Movement Leaders were invited to participate and depose before
this PH on the overall situation of Dalits in these 5 states.

Not less than 100 selected victims are to take part in this Public Hearing
(PH). This PH is first of its kind in bringing Dalit Victims from 5 states of
South India and the Observations and Recommendations of the Jury Members would
be extensively used as an Advocacy Material both within and outside the country
to ensure Justice and Protection to the Dalit Victims who are yet to gain their
Human Dignity!

  All are Welcome!
