‘Private sector can’t have quota’
- By Venkat Parsa

New Delhi, Feb. 17: Pattali Makkal Katchi (PMK) leader S. Ramadoss has been told that the government cannot bring a legislation for reservation in the private sector, as it goes against the basic structure of the Constitution.
This was revealed by Union agriculture minister Sharad Pawar, who headed the Cabinet sub-committee set up by the Centre. Dr S. Ramadoss had also raised the issue at the UPA coordination committee meeting, which was held on Tuesday night. Dr Ramadoss has been demanding introduction of a constitutional amendment to enforce reservation for SC/STs in the private sector.
Mr Sharad Pawar received legal opinion that the proposed plan to provide job reservation in the private sector for the Scheduled Castes and Scheduled Tribes will not stand legal scrutiny.
In view of the SC judgment against the reservation of jobs for the Muslims in Andhra Pradesh, the UPA is treading cautiously on the issue of reservation in the private sector.
The Cabinet sub-committee has also received opinion from experts that such a proposal, if implemented by amending the Constitution, is likely to be struck down by the Supreme Court. But it is learnt that the committee has not yet given up on the politically-sensitive issue as there is considerable pressure on the Congress-led UPA government from its constituents, including the Left, to go in for reservations in the private sector, since the government is no longer creating fresh jobs.
The National Common Minimum Programme of the Congress-led UPA government at the Centre set out the agenda. "The UPA government is sensitive to the issue of affirmative action, including reservations, in the private sector. It will immediately initiate a national dialogue with all political parties, industry and other organisations to see how best the private sector can fulfil the aspirations of the Schedules Castes and Scheduled Tribe youths," the NCMP stated.
