Just a note that this wasn't ignored on the Incubator list, but rather there was an excellent discussion on legal-discuss@ that took care of the issue.
Summary is that since the copyright holder is making the donation and is
willing to have the copyright moved to the NOTICE file, which is preferred by
the ASF, that is what will happen.
