And that's even assuming the death penalty isn't invoked. At this point, the Federal government can theoretically prosecute with the death penalty because one of the victims was an FBI agent. And both Maryland and Virginia have state death penalty statutes. That's three different jurisdictions that can try the defendants with the death penalty. Not only that, but the defense wouldn't be able to mount a "double jeopardy" argument because each of the shootings were distinct, separate events and could therefore be prosecuted individually (at the very least, there could be a different trial in each state).
