Yeah that code doesn't work... Are you testing on an emulator? I used a Droid with 2.1 and when testing with a G1 with 1.6 it gracefully gives me an http error code "403 Forbidden Access is forbidden to the requested page"
So my guess Android 2.1 has a bug handling http error codes..
