Mulkern <[EMAIL PROTECTED]> Subject: China Spy Case Lawyers Subpoenaed Thursday, March 23, 2000 China Spy Case Lawyers Subpoenaed By JIM ABRAMS, Associated Press Writer WASHINGTON--The Senate Judiciary Committee, over the objections of its Democrats and the Justice Department, on Thursday voted to subpoena two federal attorneys to discuss the light sentence given a scientist suspected of spying for China. Sen. Arlen Specter, R-Pa., demanded the subpoenas of Justice Department Criminal Division line attorney Michael Liebman and former attorney Jonathan Shapiro, saying "we have been extraordinarily, exhaustively patient" with the department but "we've had precious little cooperation." The vote was 10 -6, along party lines. Specter plans to hold a hearing next Wednesday on the case of Taiwanese-American scientist Peter Lee, who reached a plea bargain with the Justice Department and escaped prison time despite reports that he had passed advanced radar technology secrets to China. Specter said he wanted to find out why a plea bargain was struck before a full damage assessment of the alleged espionage was completed. But Assistant Attorney General James Robinson, in a letter to Judiciary Committee Chairman Orrin Hatch, R-Utah, Thursday, argued that the department had discussed the case extensively with the Senate and that subpoenaing two line attorneys who did not make final prosecution decisions in the Lee case would have a "chilling effect" on prosecutors. Robinson said Liebman is currently in New Mexico helping with the prosecution of Wen Ho Lee, the Los Alamos scientist also under suspicion of passing secrets to the Chinese, and forcing him to return to Washington to testify could disrupt that investigation. Sen. Patrick Leahy of Vermont, ranking Democrat on the committee, said the department had supplied Specter with "voluminous information" on the Peter Lee case and going to the extraordinary step of subpoenaing career prosecutors was unwarranted. "The argument could be made that it's nothing more than grandstanding." Hatch said he too was worried about the precedent of issuing subpoenas but was supporting the action because "I think Arlen's been jerked around enough." Lee in late 1997 pleaded guilty to filing a false statement about a 1997 trip to China and to revealing classified laser data during a 1985 trip. He was sentenced to a year in a halfway house with three years' probation and a $20,000 fine.
