Prison sought in Bush tape case

Prosecutors request sentence for ex-office worker

AUSTIN - Federal prosecutors have asked for up to a year in prison time
for the office worker who admitted stealing George W. Bush's presidential
debate materials, mailing them to the Al Gore campaign and then lying about
it to a grand jury.

In preparation for Juanita Yvette Lozano's sentencing Friday for mail fraud
and perjury, government lawyers also alleged for the first time that she
ran up thousands of dollars in unauthorized charges on a credit card issued
by Mr. Bush's media adviser.

Ms. Lozano could not be reached, and her lawyers did not return calls.  As
of Friday afternoon, they had not filed a response to the government's
argument for prison time. Under sentencing guidelines, Ms. Lozano faces six
months to a year, which she is eligible to serve at home or at a halfway
house.

Assistant U.S. Attorney Raymond Hulser declined to comment beyond the
sentencing memo in which prosecutors labeled her actions "a deliberate and
calculated plan involving a substantial abuse of trust."

"Presidential elections are unquestionably rough contests; but it is
equally clear that embezzling a campaign's most sensitive work product and
secretly mailing it to the opposition has no lawful place in such
ontests," government lawyers wrote to U.S. District Judge Sam Sparks.
"The defendant's crime was a serious one."

Ms. Lozano, a lifelong Democrat, was elected a party precinct judge while
working for the consulting firm Maverick Media. No evidence has emerged to
suggest other culprits in the episode.

She pleaded guilty in June, admitting that in September 2000 she swiped and
mailed a Bush videotape, strategy book and other papers to former Rep. Tom
Downey, D-N.Y., a Gore adviser, before the first presidential faceoff with
the Texas governor.

Mr. Downey promptly turned the materials over to the FBI, and agents later
identified Ms. Lozano as a likely suspect, based on surveillance videotape
from the downtown Austin post office.

They also found records of Internet searches for Mr. Downey's address on
her home computer.

Early in the investigation, Ms. Lozano insisted the post office video
showed her mailing a pair of her boss's mail-order pants back to the Gap.
To the grand jury, she didn't deny mailing the package, but said she had no
idea who the recipient was.

In her plea, Ms. Lozano said she used a Maverick Media credit card to buy
postage for the purloined package. The government sentencing memo said Ms.
Lozano made other unauthorized charges that exceeded her office manager
salary.

Her former employer, Bush media adviser Mark McKinnon, said Friday he would
not press charges for the more than $10,000 in bills Ms. Lozano ran up,
including restaurant meals and airline tickets. "We just want it over,"
said Mr. McKinnon, for whom Ms. Lozano had also worked as a baby sitter for
years.

Prosecutors said that "job-related fabrications and concealment" prompted
Ms. Lozano's dismissals from two previous jobs, noting her "fraudulent and
deceitful conduct was not an aberration."

The government memo said Ms. Lozano passed up every opportunity to solve a
mystery that had the potential to disrupt the election.  "Instead, she
chose to create a false alibi and lie repeatedly," it said.
