THE DAFYOMI DISCUSSION LIST
brought to you by Kollel Iyun Hadaf of Yerushalayim
Rosh Kollel: Rabbi Mordecai Kornfeld

[REPLY TO THIS MESSAGE TO DISCUSS THE DAF WITH THE KOLLEL]

GENERAL: Shemitas Kesafim
Yaakov Weinberg asks:
Does shemitah nullify a loan owed to the beis hamikdash?
Yaakov Weinberg, La,USA

The Kollel replies:
I am not sure I understand your exact question, as I am not aware of the
Beis Hamikdash acting as a Gemach, or of a Gizbar who is able to give loans
from the assets of the Beis Hamikdash.
If a person was Makdish something to the Beis Hamikdash I would think that
Shemitah does not take away that pledge for a few reasons. One reason would
be that this is a Mitzvah that is between a person and “Achiv” – “his
brother” not between him and Hashem. Another reason is “Amiraso l’Gevohah
k’Mesiraso l’Hedyot” loosely translated as “saying one will give to Hekdesh
is like giving something to one’s friend.” In other words, it is considered
as if the Kinyan is finished, and it is just a matter of getting the money
there, as opposed to an actual loan which is able to be used and paid back
whenever one is supposed to pay it back.
All the best,
Yaakov Montrose
