This is bad as it places the actions of a person on the space providers. In the US there was a lawsuit against an provider, the ruling said that as long as the provider did not "moderate" they were not responsible of what was posted. The person(s) posting the video should have been the ones prosecuted. But then that is one difference between the US and Italy law.
