The CVS header on /etc/init.d/serial shows that it is from the rc-scripts module on gentoo cvs, and rc-scripts is distributed as part of baselayout indeed. However it is not installed by baselayout-1.11.12-r4, and in fact it does nothing as /etc/serial.conf does not exist, so is safe to delete - but make sure (a) you aren't using it (check /etc/serial.conf) and (b) you remove it from all runlevels.
