It appears the concerns are because there is actually an Open Source
implementation of HW video decode acceleration for G45... It seems that if
there weren't any Open Source VA driver, libVA would have been accepted
already.
Ultimately, they decided to allow VDPAU into Fedora, but not VA API:

Sure, it was simpler to allow a lib to proprietary drivers and when there
was an Open Source one, they feared about patents and such.
