Some friends have expressed concern that I may be now physically attacked by Goa’s Advocate General Atmaram Nadkarni for exposing his blatant misdeeds. Knowing his erratic temperament, arrogance and awfully revengeful attitude it will come as no surprise.
Infact Atmaram Nadkarni and Chief Minister Manohar Parrikar in these traits have a lot in common. No wonder they are so glued to each other. I have nothing personal against Atmaram Nadkarni. But his attempt to undermine the independence of the Judiciary by trying to treat it as his fiefdom cannot be tolerated. A lot of people and many Advocates in particular are agonized at this pathetic state of affairs but understandably fear to speak out. Over the last 35 years of activism I have been attacked once too many but it has all but embolden me rather than deter my commitment as I would rather die than live the agony of helplessly seeing injustice. With today hunting down a human having become so cheap it may not be a cumbersome task for Atmaram Nadkarni to organize the strike with precision in an attempt to break each and every bone of mine, to silence my voice. Regardless of this looming threat, on the gross misconduct by Atmaram Nadkarni clearly, I will fearlessly keep my position until the very end. It is pointless living and carrying through the rest of your life the cross that you have to cowardly watch the aftermath of humiliation and indignity seeing the solemn edifice of the Judiciary being battered and bruised by Atmaram Nadkarni. We need to fight relentlessly to keep our judicial system ‘just’ and 'fair'. Judicial independence means that judges must be free to decide cases fairly, independently and impartially, relying solely on the facts of the specific case and the applicable law uninfluenced by lofty claims and verbosity from Shakespeare’s comedies. Judicial independence is constitutionally required. We need to protect from undue pressure the court system as an independent and an important organ of our democratic set-up. It takes fair and impartial judicial decisions to protect our rights and to uphold the rule of Law. Judiciary has to be totally independent from the Legislative and the Executive branches of government while remaining totally insulated from sharks. When one interacts with the very knowledgeable yet so suave and gentle Advocate General of Maharashtra Darius Khambata, one envies as to why Goa is not privileged to have such a distinguished Advocate General. We can only pray that we be bestowed with one soon.
