This legislation, introduced by Reps. Tom Campbell (R-CA) and David Bonior (D-MI) and co-sponsored by 29 House members, would prevent the use of secret evidence in Immigration and Naturalization Service (INS) deportation hearings. More co-sponsors are needed. Many American Muslims and civil libertarians believe secret evidence is unconstitutional and that it is used disproportionately against members of the Muslim and Arab-American communities. The act's sponsors say more than 20 of the 25 individuals held based on secret evidence are Muslims and/or Arabs. The use of secret evidence has a negative impact on our community that will only grow worse if we do not support this legislation. The "Findings" section of the proposed legislation states: No person physically present in the United States, including its outlying possessions, should be deprived of liberty based on evidence kept secret from that person, including information classified for national security reasons. Removal from the United States can separate a person from the person's family, may expose the person to persecution and torture, and amounts to a severe deprivation of liberty. Use of secret evidence in immigration proceedings deprives the alien of due process rights guaranteed under the United States Constitution and undermines our adversarial system, which relies on cross-examination as an engine of truth-seeking. MAJOR MEDIA REFERENCES TO THE USE OF SECRET EVIDENCE: The Washington Post - "The use of secret evidence is antithetical to the premises of our judicial system." (8/6/99) The New York Times - "In a practice assailed by civil liberties and Arab-American groups, two dozen suspected terrorists, all Arabs, are being detained around the country by the immigration service on the basis of secret evidence. None of the defendants and their lawyers have been allowed to see the evidence against them." (7/31/99) St. Petersburg Times (Fla.) - "Excising the use of secret evidence from our justice system will do more to protect what this nation stands for than passing a dozen anti-flag-burning amendments." (5/23/99) "...the miscarriage of justice is too consequential for Congress to ignore...The evidence, which often consists of newspaper clippings, third-hand allegations and bigoted intuition on the part of government investigators, is withheld from defendants...'" (10/10/98) The Palm Beach Post - "...secret evidence and incarceration without trial do not belong in America."
