For what little it's worth, I'm pretty sure that in the past I've had to force both copyright and registered mark symbols up into superscript territory -- but I use them very seldom, so that memory is less reliable than most (and most are not all that reliable). > Guess it's used as is > the copyright symbol rather than as the TM symbol.
