I think mysqld is telling you the daemon is already using the port. If all
you want to do is set the variable, you can set it in the [mysqld] section
of  my.cnf/my.ini:

max_allowed_packet=<n>

(the set-variable command prefix is no longer required), or you can set it
on the command line the first time you start the server.
