The 8th U.S. Circuit Court of Appeals said a five-state compact working to build the dump in northeast Nebraska acted properly when it set a deadline for the state to approve a license for the facility. The state missed that deadline by almost nine months. It denied the application in December. The ruling is important because the Central Interstate Low-Level Radioactive Waste Commission is seeking damages from the state for violating the deadline. So far costs for the 12-year-old project total more than $95 million. U.S. District Judge Richard Kopf had ruled the state cannot further review its license application until it is determined if the state intentionally delayed the licensing process. That injunction is also on appeal to the 8th Circuit. Linda Willard with the Nebraska attorney general's office said it was too early to know what action, if any, will be made in response to Monday's ruling. "Right now we're in a holding pattern as far as a licensing decision," Willard said. Gov. Mike Johanns' spokesman Chris Peterson said he had not been briefed on the ruling. Compact chair Michael Henry of Louisiana and compact attorneys could not immediately be reached for comment. The case has roots that go back to the early 1980s when Congress approved the Low-Level Radioactive Waste Policy Act. In 1986 Congress approved formation of the Central Interstate Low-Level Radioactive Waste Compact. Nebraska is a member of the compact which also includes Kansas, Arkansas, Oklahoma and Louisiana. In 1987 Nebraska was selected as the site of the radioactive waste disposal facility. In December the license application to construct the dump in Boyd County near Butte was denied. Earlier this year the state Legislature voted to withdraw Nebraska from the compact. That process is expected to take five years.
