OpenSSL 0.9.8i does not have the fips code in it. Currently, one must download one of the snapshots from ftp://ftp.openssl.org/snapshot/ (one of the openssl-0.9.8-stable-SNAP-*.tar.gz files) to build a library that can use the FIPS canister.
